COMPULSORY ATTORNEYS: MANDATORY LEGAL REPRESENTATION IN THE GAMMA AGE

Overview

The Exohuman legal system of the Gamma Age on VOI 700 D mandates that all defendants in criminal proceedings be represented by Compulsory Attorneys registered in the GAIA system.

This system, introduced in 2635 under the administration of Supreme Councilor Aisha Patel and her Communard Party government, is unique in its resource-efficient approach, reflecting the principles of Communardism and the broader Annual Plan.

Defendants are precluded from representing themselves or hiring attorneys outside the GAIA-appointed pool, ensuring centralized control over legal representation and maintaining efficiency in the allocation of professional resources.

Introduction of the Compulsory Attorney System

The decision to introduce the Compulsory Attorney system was rooted in the Communard Party's commitment to sustainability and equitable resource distribution. In the economic framework of Communardism, all professional and material resources are planned and allocated annually by GAIA, the artificial intelligence that oversees the Federal Confederation's economy. Before 2635, the option for defendants to self-represent or choose non-registered attorneys created inefficiencies:

  • Citizens preparing for self-representation consumed energy and resources beyond the calculated needs of their normal roles.
  • GAIA-appointed attorneys were underutilized, leading to waste in the carefully planned Annual Plan.

To address this imbalance, the Patel administration abolished self-representation and free attorney selection, mandating the exclusive use of GAIA-assigned Compulsory Attorneys.

The Role of Compulsory Attorneys

  • Centralized Planning and Allocation: The number of attorneys is calculated annually by GAIA based on projected legal case volumes. Attorneys are assigned to cases in a manner that optimizes resource use and minimizes waste.
  • Performance Monitoring: Attorneys are subject to standardized client evaluations after each case, ensuring accountability and quality representation.Attorneys with consistently poor ratings are replaced by GAIA.
  • Client Concerns: Clients may raise professional or personal concerns about their assigned attorney.GAIA reviews these concerns, and replacements are made when necessary, ensuring citizens feel adequately represented.
  • Limited Pool of Legal Professionals: On average, there are 4 to 7 Compulsory Attorneys active at any time in the Federal Confederation, reflecting GAIA's calculation of the system's needs.

Key Elements of the Reform

  • Efficiency Over Individual Preference: The Patel administration emphasized that prioritizing resource efficiency was vital to the survival of the Federal Confederation. This led to the exclusion of self-representation and the freedom to hire private attorneys. All legal proceedings must now align with the Annual Plan, ensuring the optimal use of human labor and energy.
  • Attorney Training and Appointment: GAIA not only calculates the number of attorneys required but also oversees their training and appointment. This ensures uniform quality and alignment with the principles of the Annual Plan.
  • Quality Assurance Measures: The dual mechanisms of client evaluations and concern reviews create a system where citizens can hold their attorneys accountable, balancing efficiency with a focus on citizen satisfaction.

Excerpt from Aisha Patel’s Government Declaration

Delivered on May 7, 2635, at the Federal Council in New Kourou:

“(…) To ensure that our legal system aligns with the resource constraints and communal values of our host planet, we must focus on the essentials. By mandating the exclusive use of GAIA-appointed attorneys, we eliminate inefficiencies and ensure that every citizen can defend their rights without compromising the broader needs of our society. Lawyers are now integral to the Annual Plan, with their performance closely monitored and adjusted. Citizens who feel unrepresented can raise concerns, which GAIA will address promptly, maintaining trust in our legal system. In this way, we create a system that is both just and sustainable, serving all members of our Federal Confederation.”
