COMPULSORY ATTORNEYS: MANDATORY LEGAL REPRESENTATION IN THE GAMMA AGE
Overview
The Exohuman legal system of the Gamma Age on VOI 700 D mandates that all defendants in criminal proceedings be represented by Compulsory Attorneys registered in the GAIA system.
This system, introduced in 2635 under the administration of Supreme Councilor Aisha Patel and her Communard Party government, is unique in its resource-efficient approach, reflecting the principles of Communardism and the broader Annual Plan.
Defendants are precluded from representing themselves or hiring attorneys outside the GAIA-appointed pool, ensuring centralized control over legal representation and maintaining efficiency in the allocation of professional resources.
Introduction of the Compulsory Attorney System
The decision to introduce the Compulsory Attorney system was rooted in the Communard Party's commitment to sustainability and equitable resource distribution. In the economic framework of Communardism, all professional and material resources are planned and allocated annually by GAIA, the artificial intelligence that oversees the Federal Confederation's economy. Before 2635, the option for defendants to self-represent or choose non-registered attorneys created inefficiencies:
- Citizens preparing for self-representation consumed energy and resources beyond the calculated needs of their normal roles.
- GAIA-appointed attorneys were underutilized, leading to waste in the carefully planned Annual Plan.
To address this imbalance, the Patel administration abolished self-representation and free attorney selection, mandating the exclusive use of GAIA-assigned Compulsory Attorneys.
Background of the introduction of Compulsory Attorneys
Since all required professional resources in the economic system of Communardism are planned and allocated by the artificial intelligence GAIA in a so called Annual Plan, the number of attorneys needed in the Federal Confederation is also calculated by GAIA.
This is to ensure a resource-efficient legal system in which no energy or human labor is “wasted.”
To achieve this goal, the government of Aisha Patel of the Communard Party, in its second term (2634-2636), abolished the previously existing right to defend oneself in court or to choose one's own lawyer.
The government declaration on the introduction of Compulsory Attorneys from 2635 (excerpt)
“(…) We live in times when human labor and available energy resources are scarce. For this reason, we decided in our first term of office that we would have to take a more focused approach to the economy in the future - concentrating on the essentials. This is the only way we can ensure that all citizens of the Federal Confederation on our host planet have enough to eat, a roof over their heads and enough energy to live on. Therefore, since 2635, we plan all economic and social activities through our annual plan. Here we determine who, what and how much must be done so that the most important needs of all of us can be satisfied. And we also determine what resources will be expended to enable us to do the necessary work.
Training, as well as the appointment of attorneys, has also been an integral part of the annual planning since 2635. But so far, we haven't really made efficient use of our appointed attorneys: When it came to court cases against them, some citizens chose to defend themselves in court. To do so, they had to obtain legal texts, study them intensively, and thus increased their energy consumption beyond the calculated needs from their normal working lives. At the same time, GAIA-appointed attorneys were underutilized because citizens did not use their services.
And this despite the fact that GAIA had calculated for us in advance, in the course of the annual plan, exactly how many lawyers would be needed approximately in the next 12 months due to legal cases.
In order to close this gap in our system, we have decided - after consultation with GAIA - that in the future we will legally exclude the possibility of defending oneself in court. To continue to use our scarce energy resources efficiently, in the interest of the community, every citizen who has to answer to a court or who files a lawsuit must have recourse to one of the public defenders appointed by GAIA.
In return, so that citizens can feel well represented, lawyers are required to obtain a standardized evaluation on their performance after each client contact. Attorneys who regularly receive poor ratings are replaced by GAIA with new legal professionals.
In addition, after the initial meeting with their attorney, a citizen has the opportunity to raise “professional and human concerns” about the attorney's assignment. These concerns are reviewed by GAIA. If GAIA upholds the concerns, the attorney is also replaced.
In this way, we ensure that we, the citizens of the Federal Confederacy continue to have an excellent legal system in which every citizen can defend their right! (…)”
The declaration was held by Aisha Patel at the 7th of May 2635 in the Federal Council at New Kourou.
